The Philippine National Police (PNP) has issued an order canceling First District Rep. Oscar “Richard” Garin Jr. and his father, Guimbal Mayor Oscar “Oca” Garin Sr.’s permits to carry firearms outside of residences (PTCFORs) and licenses to own and possess firearms (LTOPFs).
Philippine National Police (PNP) Chief Director General Oscar Albayalde, in a statement, said the cancellation of PTCFORs and LTOPFs “is an administrative action to the involvement of the Garins in a criminal case involving the use of firearms.”
The Garins, according to Albayalde, would be “duly notified of this administrative sanction to their privilege to own and possess firearms pursuant to Republic Act 10591, and will be commanded to immediately turn-in all their registered firearms to the PNP.”
Under Section 39 of RA 10591 or the Comprehensive Firearms and Ammunition Regulation Act, the PNP chief has the power to revoke, cancel, or suspend the license or permit for a firearm if the owner commits a crime or offense involving guns.
Based on the PNP’s firearms information database, Richard is a registered owner of eleven firearms, three of which have expired licenses, while Oca owns eight firearms, five of which also have expired licenses.
“All these firearms are now subject to confiscation upon revocation of their LTOPFs, effectively making them ineligible to own and possess guns,” Albayalde said.
The Garins are respondents in charges filed by PO3 Federico Macaya Jr. of the Guimbal Police Station before the Office of the Ombudsman Visayas in Iloilo City on Thursday, Dec. 27.
The charges include direct assault, grave coercion, grave threats, physical injuries, slander by deeds, serious illegal detention, and alarm and scandal.
The complaints stemmed from injuries sustained by Macaya when he was “handcuffed, manhandled, slapped and spat upon on his face and threatened at gunpoint by Richard and Oca” on Wednesday, December 26, outside the Municipal Hall of Guimbal.
“I cannot in conscience let this abuse and oppression pass without justice. I am directing the PNP Legal Service to provide legal assistance to Macaya in his complaint and possible counter charges by the respondents,” Albayalde said.
The PNP chief also endorsed to National Police Commission (Napolcom) en banc the recommendation of PRO-6 Director Chief Superintendent John C Bulalacao for the withdrawal of th deputation of Mayor Garin to exercise supervision and control over the local police of Guimbal.IMT
